LeRoy Carhart and Germantown Reproductive Health Services is prominently mentioned in latest report on abortion clinic safety entitled “Unsafe: How The Public Health Crisis in America’s Abortion Clinics Endangers Women.” This latest investigative report focuses on the increasingly suspect safety record of America’s abortion industry, including non-Planned Parenthood clinics which are currently performing two-thirds of all abortions. 

Evidence collected from 32 states on hundreds of abortion clinics (including Planned Parenthood abortion clinics) and individual abortionists establishes that the practice of abortion in America has devolved into the “red light district” of medicine and is populated by dangerous, substandard providers. Unsafe is both a “snapshot” in time, focusing only on abortion practices since 2008, and the “tip” of the proverbial iceberg, convincingly demonstrating a nationwide pattern of abuse that characterizes an industry that fights to keep profits high and standards low.

-Failure to ensure employees were proficient in Rh factor testing.

3. The Statement of Deficiencies Report from the February 13, 2013 inspection found deficiencies included:

-Administrator failed to ensure that nursing staff had experience and training sufficient to demonstrate competency in the administration and monitoring of intravenous sedation medications.

-Failure to verify staff maintained current MD sate licensure to practice as an RN at the facility for one of 2 staff reviewed. (RN license expired 1/28/12.)

-Failure to develop and implement policies and procedures to ensure staff were trained in the emergency transfer of a patient to the hospital from the facility.

-Staff failed to appropriately use single-dose medication vials and failed to label pre-drawn medication syringes.

-Failure to ensure that the patient’s medical records included a discharge diagnosis for 10 of 10 patient records reviewed.

-Failure to ensure adequate surgical instrument reprocessing in order to maintain a sanitary environment for the provision of surgical services.

4. On February 7, 2013 Jennifer Morbelli, an abortion patient of Leroy Carhart, died of 3rd trimester (33-weeks) abortion complications. She started suffering chest pain and other discomforts, and was unable to reach Carhart.  She was taken to an ER, which could not reach Carhart. She suffered massive internal bleeding in her abdominal cavity and slipped into a Code Blue condition approximately six times before dying. The Chief Medical Examiner ruled that she died because amniotic fluid from her womb spilled into her bloodstream, making her blood unable to clot.

Germantown, MD (OperationRescue.org) By Cheryl Sullenger — Topic of late-term abortions is in the headlines due to rabid support from Democrat Hillary Clinton, who denies babies are “ripped from the womb” during late-term abortions, as her opponent, Donald Trump, has said. Now, Operation Rescue has obtained court documents that confirm once again that the most-used form of late-term abortion does in fact dismember a baby, and can cause devastating harm to women as well. 

Wendy Devine, 34, is alleging in a negligence/malpractice suit filed on September 27, 2016, in Montgomery County, Maryland, that LeRoy Carhart so severely botched her late-term abortion earlier this year that she nearly died. She endured such extreme injuries that she continues to suffer permanent disability and will likely never bear another child.

Carhart is perhaps the best known abortionist in the country that will openly conduct abortions throughout all nine months of pregnancy, and does so at Germantown Reproductive Health Services in Germantown, Maryland. 

Once his home state of Nebraska passed a ban on abortions after 20 weeks in 2010, Carhart was forced to relocate his lucrative third-trimester abortion practice elsewhere. He chose Maryland for two reasons. First, Maryland has no gestational limit on abortion that would limit his business. Secondly, there were few laws to protect women from shoddy abortion practices. It was the perfect environment for someone like Carhart, who was as prone to an above average number of botched abortions, as Operation Rescue witnessed first-hand when he worked at a late-term abortion facility in Wichita, Kansas, until it closed in 2009.

But Wendy Devine had no idea about Carhart’s penchant for injuring – and even killing – his abortion patients. (Two women have died due third trimester abortions done by Carhart: Christin Gilbert in 2005 and Jennifer Morbelli in 2013.)

Devine reported to the Germantown Reproductive Health Services on January 18, 2016, trusting that Carhart and his clinic staff were the experts in the field of abortion they said they were, and competent to conduct her late-term abortion. 

That misplaced trust nearly proved fatal.

During her first appointment, Devine was given two injections into her uterine cavity through the abdominal wall, then had cervical dilators inserted. The injections were meant to end the life of her baby prior to a planned Dilation and Evacuation (D&E) dismemberment abortion scheduled for the next day. D&E abortions are commonly used in the majority of late-term abortions — especially if the abortionist is in a hurry. The rarer Induction Method, which births an intact — but still very dead — baby, requires three to four days to complete. The D&E method can be done much quicker.

Afterwards, Devine was sent back to a nearby hotel, where she had made arrangements to stay during the two-day abortion process.

The next day, Devine dutifully reported back to Germantown Reproductive Health Services for the completion of her D&E abortion. Once the procedure was done, Devine immediately knew something was wrong. 

According to the malpractice complaint she filed in Montgomery County, a lethargic Devine complained of severe abdominal pain. Because she was bleeding so heavily, she also suffered from very low blood pressure, which caused her heart to race as it struggled to pump an insufficient amount of blood through her system.

Throughout the day, her condition deteriorated to the point that at 7:41 p.m. – long after closing hours – a 911 call was finally placed by a GRHS employee.

But to listen to the 911 call for help, one would think the emergency transport was a simple precautionary act. 

On the heavily redacted 911 recording, obtained by Operation Rescue, a cheery clinic worker is heard asking for transport for a patient for observation, downplaying the seriousness of the injuries, which become apparent later in the call.

Carhart and his wife, Mary Lou, could be seen on security camera footage leaving the abortion facility immediately after the ambulance, but in the opposite direction.

Devine’s court records filled in the details that the redacted recording left out. 

When Devine finally arrived at the hospital at 8:35 p.m., she was bleeding heavily, was extremely weak, and still suffering severe abdominal pain. Lab tests revealed that her hematocrit and hemoglobin numbers were at “panic levels.” 

Normal hematocrit levels for females is 36 to 48%, but Devine’s measured only 16%. Normal hemoglobin levels for females is 12-16, while hers came in at 5.4.

Hospital E.R. doctors called in a gynecologist who examined her and prepped her for surgery.

At 10:20 p.m., Devine was rolled into the emergency room for an exploratory laparoscopy, but what was discovered was so serious that the procedure was converted to an open laparotomy and an additional specialist was called in. 

Here is what surgeons found:

Once all her injuries were repaired in what had become an “extensive” surgery, according to Devine’s complaint, she was transferred to the recovery room and the tube that held open her airways was removed.

But Wendy Devine was not out of the woods yet. Not by a long shot.

In recovery, Devine suffered a spasm of her swollen larynx and required re-intubation. She was transferred to the Intensive Care Unit where she developed aspiration pneumonia. She developed sepsis, a dangerous, life-threatening condition that occurs when the body’s response to infection causes damage to other organs.

Devine spent a full seven days in the ICU and was hospitalized 11 days in all.

Devine’s attorney described her recovery as “tortuous and difficult.” She suffered “massive internal scarring, suffers with recurrent and severe pain…and faces the significant risk of being unable to conceive and/or carry a pregnancy to term.”

As a result to the horrifically botched abortion, Devine suffers “severe and permanently disability,” along with emotional anguish and fear.

The complaint alleges gross violations of patient care standards by Carhart and Germantown Reproductive Health Services. To back up that claim, an expert opinion (see pg. 12) was submitted with the complaint from a physician who reviewed Devine’s medical records and determined that her serious injuries were due to Carhart’s violation of standards of care.

Devine has filed a similar complaint in Baltimore County as well. Both cases are active and progressing.

Carhart also has other legal troubles to worry him. In May, the House Select Panel on Infant lives issued subpoenas to Carhart and GRHS for information related to his suspected involvement in the illegal trafficking of aborted baby remains, and incidents of babies that may have been born alive during late-term abortions conducted by him. The Select Panel continues to investigate him.

“So when Hillary Clinton voices support for late-term abortions, remember what happened to Wendy Devine and her dismembered baby. Remember what happened to dead Carhart abortion patients Jennifer Morbelli and Christin Gilbert, and the thousands upon thousands of other women who have suffered from risky late-term abortion procedures, and ask yourself whether, as a nation, we can tolerate such barbarity,” said Troy Newman, President of Operation Rescue. “Please join me in voting for Donald Trump, who strongly opposes abortions like the one that maimed Carhart’s late-term abortion patient earlier this year.”

Appearing as a hateful activity that’s ‘all the rage’ among pro-choice antagonists, Germantown Pregnancy Choices (GPC) was recently ‘glitter bombed’, receiving the above letter with large amounts of glitter in the envelope so that when opened it all falls out making the message, a mess.  However, that didn’t happen since the staff was familiar with these tactics.  That said, there is a sense of pride that the letter was sent to GPC. Tuesday November 11th - Just as occurred yesterday, eye witnesses describe Carhart clinic workers attaching defamatory signs to their personal automobiles, one in front of the Pro-Life pregnancy center, Germantown Pregnancy Choices, and another in front of Carhart’s clinic. Only this time one of Carhart’s workers flaunted the sign for the camera first. The signs read “13230 for Harassment”. A clear reference to the address of Germantown Pregnancy Choices, 13230 Executive Park Terrace. 

One of the more remarkable aspects to these recent events, is that the hired off-duty Montgomery County Police officer stood by and clearly watched everything, and did nothing, as shown in the video. Lack of intervention on his part, as a sworn officer of the law, can easily be construed as approval.  

Today differed from yesterday however, no signs were posted that read “13233 for Abortion”.  The address of Germantown Reproductive Health Services is 13233 Executive Park Terrace.  But the message from Carhart’s clinic yesterday and today was very clear, if you want to be harassed go to office number 13230.

For defamation to exist four elements are generally required: 1) a false statement purporting to be fact concerning another person or entity; 2) publication or communication of that statement to a third person; 3) fault on the part of the person making the statement amounting to intent or at least negligence; and 4) some harm caused to the person or entity who is the subject of the statement (SOURCE: Legal Information Institute).  

Woman’s Heartbreaking Letter to Her Unborn Baby: “I’m Aborting You Next Friday”.

Montgomery County's requirement that pregnancy centers post signs to warn women if they are not being advised by medical professionals was struck down in March 2014.

Matt Bowman, senior legal counsel with the Alliance Defending Freedom and co-counsel in the case, said the recent settlement covers what it cost for attorneys to defend “against the unconstitutional law and to restore freedom.” The settlement also include $1 in damages paid to Centro Tepeyac.

Germantown, MD (Operation Rescue) – Three months after making an open records request for a 911 call originating from LeRoy Carhart’s Germantown Reproductive Health Services abortion clinic on November 26, 2013, Operation Rescue has finally received a 911 recording from the Montgomery County Fire and Rescue Service indicating that the patient was hemorrhaging from complications to a late-term abortion.

In addition to taking weeks beyond the statutory deadlines to comply with Operation Rescue’s open record request, the recording was heavily redacted, omitting information that has previously been obtainable by the public, indicating a policy change that actively protects the abortion clinic.

“While the Maryland Public Information Act allows for the records custodian to exercise a certain amount of discretion in what is released, the redactions made in the November 26, 911 recording represent a gross abuse of that discretion at the expense of the public that has a right to taxpayer-funded 911 communications, as long as patient identifying information is removed,” said Troy Newman, President of Operation Rescue. “The omissions of information go far beyond anything we have previously obtained from the Montgomery County Fire Department. However, there have been no changes whatsoever in the MPI or FOIA laws that would account for the policy change. It appears to be a political one meant to protect the abortion clinic from scrutiny.”

Answers to nearly identical questions posed by a Montgomery County dispatcher on a 911 recording from a similar abortion emergency at GRHS on July 9, 2013, were released in full. That recording and accompanying video, which showed Carhart escorting a woman on a gurney out of the clinic to an awaiting ambulance, was shown on Fox News.

“We suspect that the news broadcast prompted Carhart or his attorneys to intimidate the Montgomery County Fire and Rescue Service into covering up information that is damaging to him,” said Newman. “If that is what happened it is a complete abuse of the system.”

In spite of the over-redactions, Operation Rescue was able to determine that the patient was hemorrhaging based on the line of questions asked by the emergency dispatcher, including a question concerning whether the patient requiring emergency medical assistance was on any blood thinners.

“Questions about blood thinners are only asked if there is heavy bleeding involved,” said Newman.

The November 26 incident was videotaped by local pro-life activists. Witnesses on the scene described a visibly pregnant woman who was wheeled out of the abortion clinic completely covered in a sheet. The patient was rushed to Shady Grove Hospital where she underwent emergency surgery, according to information received by Operation Rescue.

Germantown Reproductive Health Services is one of the few abortion clinics that openly offers abortions through all 9 months of pregnancy. It is not equipped to handle the serious late-term abortion complications that occur there.

Carhart, who lives in Nebraska, holds no hospital privileges anywhere and has not since 1982. This creates continuity of care issues for patients who routinely suffer life-threatening abortion complications at GRHS. For example, in February 2013, Jennifer Morbelli died from complications to a 33-week abortion done by Carhart who was unreachable by family and hospital staff as her condition deteriorated. However, the Maryland Board of Physicians declined to hold Carhart accountable for his failure to provide Mrs. Morbelli with the same continuity of care that is required from other physicians.

Operation Rescue documented four medical emergencies, including Morbelli’s death, involving Carhart last year alone. Three of the incidents took place in Germantown and the fourth at his abortion clinic in Bellevue, Nebraska.

“Carhart has a network of enablers that have thus far shielded him from accountability for hurting one woman after another. Now it appears that the Montgomery County Fire and Rescue Services has joined that network of secrecy that ensures that more women will suffer injury or even death in the future,” said Newman.

Germantown, MD (Operation Rescue) – For the second time this year, one of LeRoy Carhart’s abortion patients were rushed to Shady Grove Hospital (SGH) in Maryland for emergency treatment after a late-term abortion.

On Tuesday November 26th at 11:45 a.m., an ambulance arrived at Germantown Reproductive Health Services and loaded a women for transport to the SGH emergency room. Sources inform Operation Rescue that the women underwent emergency surgery at the hospital.

Video taken by a local pro-life activist showed a woman covered head-to-toe in a sheet and that neither Carhart nor any of his staff accompanied the injured woman from the clinic to the ambulance.

On July 9, 2013, another Carhart patient was transported to Shady Grove Hospital suffering from hemorrhaging, according to 911 records obtained by Operation Rescue which published a video showing Carhart escorting his injured patient to the ambulance.

But the most tragic incident occurred in February when 29-year old Jennifer Morbelli died after a 32-week abortion done by Carhart, who left town immediately completing the abortion and was unavailable to Morbelli as her condition worsened. Hours later, Morbelli was taken by her family to Shady Grove Hospital where she died. The Maryland Board of Physicians tragically refused to hold Carhart responsible for patient abandonment even though he has no hospital privileges and informed Morbelli to return only to the abortion clinic in the event of complications.

“We told everyone who would listen that if Carhart was not disciplined, he would injure or kill again. We take no pleasure in saying, ‘We told you so,’” said Troy Newman, President of Operation Rescue. “The Maryland Board of Physicians is partially responsible for the most recent abortion injuries suffered by women who were left vulnerable by them to Carhart’s shoddy practices. Late-term abortions are too dangerous to take place in outpatient clinics such as Germantown Reproductive Health Services, especially when abortionists like Carhart are incapable of providing continuity of care in the event of increasingly frequent life-threatening complications.”

Germantown Reproductive Health Services’ post-abortion instruction forms that were modified after Morbelli’s death were obtained by Operation Rescue. The documents urge women suffering complications to contact the clinic first, even though minutes of delay can sometimes mean the difference between life and death. Patients are told to go to the hospital emergency room only as a last resort. The instructions state:

The Maryland Coalition for Life, which has partnered with Operation Rescue to expose abortion abuses, will hold a rally on Sunday, December 8 at 2pm outside Germantown Reproductive Health Services to mark 3 years since the arrival of Leroy Carhart in Maryland. The rally will memorialize the thousands of lives lost to abortion and celebrate the 125 lives that have been saved from abortion by Carhart over the past 3 years. The rally will be followed by a 1.2 mile prayer walk around the heart of Germantown.

Germantown, MD (Operation Rescue) – On the afternoon of July 9th an ambulance arrived at Germantown Reproductive Health Services, a late-term abortion clinic in Germantown, Maryland, and transported one of LeRoy Carhart’s abortion patients to a local hospital.

The woman had been in contact with pro-life activists prior to her abortion, but continued on with the 2-day procedure. During her second day of the procedure, her husband slept in the care with their three young children while she was inside the abortion clinic.

Video of the incident taken by a local pro-life activist shows that Carhart got into the ambulance and went with the patient to the hospital even though he has no hospital privileges anywhere, and hasn’t since 1987.

The woman appeared to be conscious enough to pull a sheet over her head as she was wheeled to an awaiting ambulance. The extent of her injuries are unknown at this time.

This is the second medical emergency involving a Carhart abortion patient this year. On Feb. 7, 2013, Jennifer Morbelli died from complications to a 33-week abortion after Carhart left town and was unavailable to provide emergency assistance to her or her family. Carhart remains under investigation by the medical board in relation to that incident.

“How many more women must be injured or killed by LeRoy Carhart? We need the medical board and other Maryland officials to halt the endless delays and take swift action to protect the public from this shoddy abortionist,” said Troy Newman, President of Operation Rescue. “We predicted this would happen and no one listened. Now it’s time for Maryland authorities to buck up and do the right thing before anyone else lands in the hospital or the morgue.”

Emergency 911 Call From July 9th Now Released...

A heavily redacted copy of a 911 call placed on July 9, 2013, from Germantown Reproductive Health Services in Germantown, Maryland, for an abortion patient that was suffering from heavy bleeding has been obtained by Operation Rescue.

Monday, December 10, 2012 marked two years of abortionist Leroy Carhart’s presence in Germantown, Maryland (see original TV news report from December, 2010), where he performs 2, 3, and 4 day late term abortions (1,300 feet from a church, and 400 feet from a child care center) at 13233 Executive Park Terrace.  Women from all over the east coast, as far away as Ohio, New York and South Carolina regularly come to his office to abort their 2^nd and 3^rd trimester babies.  Carhart has flown to Maryland from Nebraska every week since his home state passed a "Fetal Pain Law” which outlawed abortions after 20 weeks based on evidence that unborn babies do in fact feel pain at that gestational age.

For two years, hundreds of pro life believers from many faith denominations have braved all kinds of adverse weather conditions to be voice for the voiceless and to stand as a witness to the value of human life.  They can be seen weekly on Monday mornings from 8 to 10am on Wisteria Drive praying peacefully, holding signs and waving to traffic beeping in support.  Not all the response is positive however, verbal harassment and ridicule is common from those who support a woman’s right to procure an abortion, even up to the moment of birth, as the law allows here in Maryland.  

Unfortunately, it is estimated that more than 1,300 abortions have been performed during these two years, many on women clearly in the late stages of pregnancy.  But, the good news is that as the prayerful presence continued over the months following Carhart’s arrival, a coordinated effort to help the women and provide alternatives to abortion has arisen from the community.  There is now a team of sidewalk counselors present in front of Carhart’s office at critical times that offer help and options to women who are seeking abortions there.  Their conservative estimate is that over the last year or so, 75 women have changed their minds and kept their babies.

Germantown Pregnancy Choices (GPC) is a pro-life resource and referral office directly across the parking lot from the clinic.  It opened in April of 2011 in direct response to the late term abortion clinic. GPC is sponsored by the Maryland Coalition for Life. Staffed entirely by volunteers from local churches in the Germantown area, GPC serves the needs of women seeking assistance or information to continue their pregnancy.   

Pro-lifers on the street in Germantown have been blessed to meet and hold several of these children after they were born as their mothers brought them to visit on Monday mornings and share their gratitude that they were intercepted before going into the abortion clinic.

In addition to the regular Monday morning witnesses, Wisteria Drive has been the site of multiple 40 Days for Life events where Christians from numerous local churches pray on the sidewalk to end abortion from 6am to 12 Midnight continuously for 40 days.  This national movement has spread quickly across the globe as people of Faith respond to the call to support and stand for the Culture of Life in order to defeat the ongoing negative impact of abortion on women and families in our community. The next “40 Days” in Germantown will coincide with Lent and starts on February 13, 2013. 

Formal complaints have been filed against abortionist Leroy Carhart and his late-term abortion clinic in Germantown, Maryland, after an investigation by pro-life activists uncovered the illegal dumping of biohazardous waste, private patient medical information, and dangerous drugs.

I am very sad that I, never got to do any of these things.  My parents did not let me be born.

With great JOY, we give thanks to God for the arrival of a healthy baby boy, Christian Miles --born January 27!  Due to our presence on a Monday morning, his mother chose life for her baby!  This child and mother are another confirmation as to why we MUST persevere.  His mother is deeply grateful that we were there --bless you all! 

Blessings to all of you!  It was a wonderful day for all of those who attended with us at the Monday AM Germantown Vigil and the Annual March for Life in DC --so many visitors were moved to hear about our efforts in Germantown!

Beautiful things were happening Monday morning in front of Carhart's facility.  Of the 6 mothers went into the facility that day, 4 MOTHERS LEFT THE FACILITY AND CHOSE LIFE FOR THEIR BABIES!!!

Our presence is essential!  Praise Our Lord for this blessing on a day when so many hundreds of thousands sacrificed in the cold rain to uphold the Sancity of Life!!!!

Last Monday, January 9th, 150 joined in prayerful protest.  2 mothers did not end the lives of their child and on Tuesday, another mother chose LIFE. --Praise God!

Over 2,170 people, including 10 Pastors & Ministers and 17 Priests, were in attendance and stood for life on the morning of Monday, December 5th outside Germantown Reproductive Health Services.  This memorial event marked the termination of 720 pregnancies in the one year since Leroy Carhart has been in Germantown.  Because of our presence, three out of four mothers scheduled for abortions that day, chose life for their babies!

As evidence of the magnitude of the deaths, 720 crosses were placed on the side of the street by the Knights of Columbus, one for each of the babies aborted by Leroy Carhart in Germantown just this past year alone.

The tremendous local turnout was a true sign of prayerful unity. Both sides of Wisteria Drive were lined men, women, and children. With schools allowing students to miss classes in order to attend, young and old alike were holding signs, praying, all with car horns honking for life as they drove by.
