Tuesday November 11th - Just as occurred yesterday, eye witnesses describe Carhart clinic workers attaching defamatory signs to their personal automobiles, one in front of the Pro-Life pregnancy center, Germantown Pregnancy Choices, and another in front of Carhart’s clinic. Only this time one of Carhart’s workers flaunted the sign for the camera first. The signs read “13230 for Harassment”. A clear reference to the address of Germantown Pregnancy Choices, 13230 Executive Park Terrace.
One of the more remarkable aspects to these recent events, is that the hired off-duty Montgomery County Police officer stood by and clearly watched everything, and did nothing, as shown in the video. Lack of intervention on his part, as a sworn officer of the law, can easily be construed as approval.
Today differed from yesterday however, no signs were posted that read “13233 for Abortion”. The address of Germantown Reproductive Health Services is 13233 Executive Park Terrace. But the message from Carhart’s clinic yesterday and today was very clear, if you want to be harassed go to office number 13230.
For defamation to exist four elements are generally required: 1) a false statement purporting to be fact concerning another person or entity; 2) publication or communication of that statement to a third person; 3) fault on the part of the person making the statement amounting to intent or at least negligence; and 4) some harm caused to the person or entity who is the subject of the statement (SOURCE: Legal Information Institute).
